1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Shop Genius ("we," "us," or "our") regarding your use of our price comparison platform and all related services, features, and content.

By creating an account, searching for products, subscribing to our newsletter, submitting community content, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting. Significant changes will be communicated via email notification (for registered users), a prominent notice on our website, or an updated "Last Updated" date at the top of this page. Your continued use of Shop Genius after any changes constitutes acceptance of the modified Terms.

2. Eligibility

To use Shop Genius, you must meet the following requirements:

• You must be at least 13 years of age, or the minimum age required in your jurisdiction
• If you are under 18 years of age, you must have the consent of a parent or legal guardian to use our services
• You must not be barred from using our services under applicable law

By using Shop Genius, you represent and warrant that you meet all eligibility requirements described above. If you do not meet these requirements, you must not access or use our platform.

3. Description of Service

Shop Genius is a free price comparison platform serving Southeast Asia. Our services include:

• Product Aggregation: We aggregate product information from multiple e-commerce platforms, including Lazada, Shopee, and AliExpress
• AI-Powered Search: Search queries are optimized using Google Gemini for more relevant results
• Visual Product Search: Upload an image to find similar products using AI-powered image recognition
• Knowledge Graph Recommendations: Product recommendations powered by Cognee for smarter discovery
• User Accounts: Save favorites, set preferences, and maintain search history with a personal account
• Community Tips: User-submitted deals, store reviews, and shopping tips shared with the community
• Newsletter: Opt-in email updates on deals, features, and shopping tips
• Price Comparison: Compare prices, ratings, reviews, and other product attributes across platforms

4. User Accounts

4.1 Registration

To access certain features (favorites, personalized recommendations, community participation), you may create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and never share your credentials with others
• Accept responsibility for all activities that occur under your account
• Promptly update your information if it changes

You may also sign in using Google OAuth. Regardless of your registration method, you remain responsible for maintaining the security of your account.

4.2 Account Security

You must notify us immediately at shopgenius.app@gmail.com if you become aware of any unauthorized access to or use of your account. We are not liable for any losses arising from unauthorized use of your account. We employ industry-standard security measures including password hashing, HTTPS encryption, and rate limiting to protect your account.

4.3 Suspension & Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse our services or attempt to harm our platform
• Pose a security risk to the platform or other users

You may delete your account at any time by contacting shopgenius.app@gmail.com. Account deletion requests will be processed within 48 hours. Upon termination, your right to use Shop Genius immediately ceases. Provisions that should survive termination — including disclaimers, limitations of liability, indemnification, and intellectual property — will remain in effect.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use Shop Genius to:

• Search for and compare products across supported platforms
• Save products to your favorites and track prices
• Use our AI-powered search and image recognition features
• Share product links with others
• Submit community tips, deals, and feedback
• Subscribe to our newsletter for deals and updates

5.2 Prohibited Activities

The following activities are strictly prohibited:

• Automated Data Collection: Using scripts, bots, scrapers, crawlers, or any automated means to access, collect, or extract data from Shop Genius is strictly prohibited. This includes but is not limited to scraping product data, pricing information, search results, or user content.
• Data Republishing: Republishing, redistributing, or commercially exploiting Shop Genius data, price comparisons, or search results without our prior written permission is prohibited
• Unauthorized Data Use: Using our data on other affiliate, comparison, or e-commerce sites without written authorization and proper attribution
• Reverse engineering, decompiling, disassembling, or otherwise attempting to access the source code of our platform
• Uploading or transmitting malicious content, viruses, worms, trojans, or any harmful code
• Impersonating others or creating fake or misleading accounts
• Violating any applicable local, national, or international laws or regulations
• Interfering with or disrupting other users' access to our services
• Using the platform for unauthorized commercial purposes
• Collecting, harvesting, or storing personal information of other users
• Circumventing security measures including rate limiting, bot detection, or CAPTCHAs
• Posting spam, misleading information, or harmful content in community sections

6. User-Generated Content

Shop Genius allows users to submit tips, reviews, deals, images, and other content to our community section ("User Content"). By submitting User Content, you agree to the following:

6.1 Ownership & License

You retain ownership of the content you submit. However, by submitting User Content to Shop Genius, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, modify, adapt, and distribute your content on our platform and in connection with our services.

6.2 Editorial Control

We reserve absolute discretion to publish, edit, refuse, or remove any User Content at any time and for any reason, without prior notice. We are under no obligation to publish or maintain any User Content.

6.3 Content Standards

User Content must not be:

• Illegal, threatening, abusive, or harassing
• Obscene, vulgar, or sexually explicit
• Defamatory, libelous, or invasive of privacy
• Infringing on any intellectual property or proprietary rights
• Misleading, fraudulent, or deceptive
• Spam or unsolicited advertising

6.4 Your Representations

By submitting User Content, you represent and warrant that you have the right to submit the content, that it does not violate any third-party rights, and that it complies with these Terms. We are not responsible for the accuracy, completeness, or reliability of any User Content.

7. AI Services & Image Processing

Shop Genius uses artificial intelligence services to enhance your experience. By using our platform, you acknowledge and agree to the following:

• Search queries may be processed by Google Gemini to optimize and improve search results
• Product data may be processed by Cognee to generate knowledge graph recommendations
• Images you upload for visual search are sent to AI services for product identification and matching
• Uploaded images are deleted immediately after processing — they are never permanently stored on our servers
• AI services process search queries and product data only; they do not receive your personal account information

AI-generated results, recommendations, and product matches are provided "as is." While we strive for accuracy, we do not guarantee the completeness, correctness, or reliability of AI-powered results. Always verify product details before making a purchase.

8. Third-Party Platforms & Affiliate Disclosure

8.1 Relationship with E-commerce Platforms

Shop Genius displays product information from Lazada, Shopee, and AliExpress. We are not affiliated with, endorsed by, or officially connected to these platforms unless explicitly stated.

8.2 Affiliate Transparency

Shop Genius participates in affiliate programs. When you click "Buy Now" or similar links and are redirected to a third-party platform, we may earn a commission on qualifying purchases. Important points:

• Affiliate commissions do NOT increase the price you pay
• These commissions fund our free service and keep Shop Genius accessible to everyone
• Affiliate relationships do NOT influence our search algorithm, product rankings, or "Top Pick" selections

8.3 Third-Party Terms Apply

When you purchase from Lazada, Shopee, AliExpress, or any linked retailer, their terms of service, privacy policies, and refund policies apply. We are NOT responsible for:

• Product quality, authenticity, or accuracy of descriptions
• Order fulfillment, shipping, or delivery
• Returns, refunds, or customer service
• Disputes between you and sellers or platforms
• Changes in prices, availability, or product details after you leave our site

9. Accuracy of Information

9.1 Product Information

We strive to display accurate product information, prices, ratings, and availability. However, all product data is sourced from third-party platforms and APIs, and we cannot guarantee it is always current or accurate:

• Prices can change rapidly due to sales, promotions, or currency fluctuations
• Product availability may change without notice
• We cache results for performance, which may cause slight delays in updates
• Product descriptions, images, and specifications are provided by third-party sellers

9.2 Search Results & AI

Our AI-powered search and ranking algorithms aim to provide the most relevant results, but we do not guarantee:

• Completeness of search results across all available products
• Accuracy of AI-generated product matches for image searches
• That "Best Match" or "Top Pick" labels represent the best choice for your specific needs — these are algorithmic determinations, not personal endorsements

9.3 Currency Conversion

Exchange rates displayed on Shop Genius are updated daily from public sources and are provided as estimates only. The actual price you pay depends on the seller's pricing and your payment processor's exchange rate at the time of purchase.

10. Intellectual Property

10.1 Our Content

Shop Genius owns or licenses all content on our platform, including:

• Website design, layout, user interface, and user experience
• Shop Genius name, logo, and branding elements
• Source code, algorithms, and proprietary technology
• Articles, tutorials, guides, and educational content

You may not copy, reproduce, distribute, modify, or create derivative works from our content without our prior written permission.

10.2 User Content License

You retain ownership of the content you submit to Shop Genius. By submitting content, you grant us the license described in Section 6. Images uploaded for visual product search are processed under a limited license and deleted after use.

10.3 Third-Party Content

Product images, descriptions, trademarks, and other content displayed from third-party platforms belong to their respective owners. Shop Genius does not claim ownership of any third-party or retailer content.

10.4 Intellectual Property Infringement Claims

We respect the intellectual property rights of others and respond to infringement claims promptly. If you believe that content on Shop Genius infringes your intellectual property rights, please contact us at shopgenius.app@gmail.com with:

• A description of the copyrighted work or intellectual property you claim has been infringed
• The location (URL) of the allegedly infringing content on our site
• Your contact information (name, email, address)
• A statement that you have a good-faith belief that the use is not authorized by the rights owner, its agent, or the law

11. Newsletter & Email Communications

Shop Genius offers a newsletter service for users who wish to receive updates about deals, features, and shopping tips:

• Newsletter subscription is entirely voluntary and opt-in only
• We use MailerLite as our email delivery service provider
• You can unsubscribe at any time using the unsubscribe link included in every email
• By subscribing, you consent to receiving periodic emails about deals, new features, and platform updates

Regardless of your newsletter preference, we may send you essential service-related emails regarding account security, major platform changes, or legal updates that affect your use of Shop Genius.

12. Electronic Communications Consent

By using Shop Genius, you consent to receiving electronic communications from us, including:

• Service notifications and platform announcements
• Account alerts and security notices
• Responses to your inquiries and support requests
• Legal notices and updates to these Terms

You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. You may opt out of marketing communications at any time, but you may not opt out of essential service communications related to your account or legal obligations.

13. Disclaimer of Warranties

Shop Genius is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness of information
• Warranties of uninterrupted, timely, or error-free service
• Warranties of security or freedom from viruses, malware, or other harmful components

We do not warrant that search results, product information, or AI-generated recommendations will meet your specific requirements or expectations. Your use of Shop Genius is at your sole risk.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Shop Genius and its owners, employees, agents, and partners shall NOT be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, goodwill, or business opportunities
• Damages arising from purchases made on third-party platforms or services
• Errors, inaccuracies, or omissions in product information
• Service interruptions, downtime, or technical issues
• Actions, omissions, or policies of third-party platforms or sellers

Our total aggregate liability to you for all claims arising out of or relating to your use of Shop Genius shall not exceed the total amount paid by you to us, which is zero for users of our free service.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the minimum extent permitted by applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Shop Genius, its owners, employees, agents, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your violation of these Terms of Service
• Your use or misuse of our services
• Your violation of any third-party rights, including intellectual property rights
• Content you upload, submit, or share on our platform
• Your violation of any applicable laws or regulations

16. Service Changes & Discontinuation

We reserve the right to modify, suspend, or discontinue any aspect of Shop Genius at any time, with or without notice. This includes but is not limited to:

• Adding, modifying, or removing features and functionality
• Changing the design, layout, or user experience
• Modifying or discontinuing support for specific platforms, APIs, or services
• Suspending or discontinuing the entire service

We will make reasonable efforts to provide advance notice of significant changes that materially affect your use of Shop Genius. However, we are not liable to you or any third party for any modification, suspension, or discontinuation of our services.

17. Governing Law & Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law principles.

17.2 Informal Resolution First

Before filing any formal legal claim related to your use of Shop Genius, you agree to first contact us at shopgenius.app@gmail.com to attempt to resolve the dispute informally. Both parties agree to engage in good-faith efforts to resolve any dispute. You agree to allow at least 30 days for informal resolution before pursuing any formal legal action.

17.3 Formal Disputes

If informal resolution efforts fail, any disputes arising from or relating to these Terms or your use of Shop Genius shall be resolved exclusively in the courts of Thailand. By using our services, you consent to the personal jurisdiction of the courts of Thailand.

18. General Provisions

18.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

18.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shop Genius regarding your use of our platform and services, and supersede any prior agreements or understandings.

18.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision shall be effective only if in writing and signed by Shop Genius.

18.4 Assignment

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, reorganization, or sale of assets, without your consent. You may not assign or transfer your rights under these Terms without our prior written consent.
